Smoking & Drinking Policies

The following ordinances and policies help to protect children and their families. These rules give non-criminal enforcement authority to the Westfield Police Department and or Westfield Health Department. Violations are subject to warnings, $50 fines for first offenders, and $100 fines for subsequent offenses.

The City of Westfield does not allow smoking in city-owned parks, playgrounds, and spray parks per the ordinance under the Massachusetts General Law (MGL) chapter 270, section 22. The ordinance was voted on by the City Council on November 17, 2011 and was sponsored by former at-large councilor Nicholas Morganelli and L and O members to:

Protect the public health and welfare by restricting smoking in all outdoor places of recreation, and Assure smoke-free air to nonsmokers. Recognizing the need to breathe smoke-free air shall have priority over the desire to smoke in public.

No person shall possess, drink, or consume any alcoholic beverage or any malt beverage in city-owned schools, parks, or playgrounds. Please see Sec. 11-68 - Consumption, possession of alcoholic beverages, from Westfield's Code of Ordinances, for more details.

Indoor or Outdoor Recreation -Defined as any city-owned, operated, or leased area which is or may be open to and used by the general public, including, but not limited to:

  • Athletic fields
  • Playgrounds
  • Bike trails
  • Fields
  • Gardens
  • Skate Park
  • Parks, Playgrounds 
  • Spray parks
  • Or any City-owned buildings or property.
